    Don't Let Your Host HOSE You Out of Business

    Merriam Webster offers a slang definition of the word hose: to deprive of something due or expected. When the company you choose to host your auction business website doesn't perform as you expect it to (or, as it promises to), then you've been hosed out of expected revenue.

    Why?

  • Your visitors attempt to access your auction website and receive an error message that states your website is unavailable at the moment. They wonder if (a) you didn't pay your bill; (b) you're really unprepared for heavy traffic; or (c) you chose a really bad web host. Neither of these choices look good for you. Remember one of the most important rules for marketing: marketing is about how you present yourself to potential clients/customers. If your auction website is constantly unavailable, that leaves a very bad impression. Bad impression = lost revenue.

    Be smart! Choose a web host using these basic guidelines:

    1. Ask about their downtime/uptime and find out if they inform you in advance about maintenance. You want to be able to create a professional error message that tells your website visitors that your site is down for maintenance. Use this professional error message to let them know when your site will be back up and running.

    2. Make sure you will get a statistics program with your hosting service. You want to be able to know exactly where your visitors came from and what keyword phrases they used on what search engines to find you. This will help you tremendously with your marketing efforts.

    3. Make sure you have a toll free number to reach tech support. You want something fixed immediately -- not tomorrow morning; not next week. If the company does not have a toll free tech support number, make sure they have a 24 hour email tech support service. If tech support does not respond to your emails, find a new host immediately. That's unprofessional and shows you how [b]they[/b] market themselves.

    4. Make sure you know what you're buying. You may think that 5GB of data transfer is a lot for your $9.99 a month, but if you're running a popular message board, it's not. Graphics are a part of your data transfer so you could easily go over that 5GB a month and end up paying way more than you expected, or worse, waking up to find your auction website shut down until you pay your host because you went over your 5GB allotment for the month. Ask them how they handle it when you go over your transfer allotment. Many sleezy hosts won't tell you that they shut your website down because they want to hold your website hostage until you pay them more money.

    5. How long has that host been in business? Many professional looking website hosts are some of the worsts out there. Don't be fooled by great graphics and professional appearances. Check around. A search for "web hosting forum" on Google or any major search engine will give you the goods on who to use and who to avoid.

    6. Be sure you do some comparison shopping. The cheapest isn't always the best; the most expensive isn't always the most reliable.

    7. READ YOUR CONTRACT! Many hosting companies will state that they are not liable for any damages that occur from any downtime. Basically, that means, you are potentially waiving your rights to sue your web host if your website is down for 2 weeks and you lose sales. Keep that in mind before you invest a lot of time, money, and energy into designing your auction website and then handing it over to slimyjimswebhost.com

    Eminem Unfinished Tracks on eBay?

    According to a recent article, someone from rap artist Eminem's camp stole some unfinished tracks and attempted to sell them on eBay. Surprise, suprise! The alleged violation was spotted by someone from Eminem's record company (what were they doin' on eBay? Just cruisin' for stolen unfinished Eminem tracks?).

    According to the article:

    "Investigations are underway into the rapper's own camp to find the culprit who tried to pirate the tracks before they were spotted by an Interscope executive, according to New York's Page Six."


    Since when do busy executives play detective? Isn't that the job of a peon? Can we say "Marketing Scheme?"

    Intellectual Property and the Online Auction Seller

    Many auction sellers find their pictures and auction ads being used by other auction sellers and scream "that's a violation of my intellectual property rights!" But is it?

    Intellectual property is defined as:

    "A product of the intellect that has commercial value, including copyrighted property such as literary or artistic works, and ideational property, such as patents, appellations of origin, business methods, and industrial processes."

    The American Heritage® Dictionary of the English Language, Fourth Edition Copyright © 2000 by Houghton Mifflin Company.

    Intellectual Property:

    "The ownership of ideas and control over the tangible or virtual representation of those ideas. Use of another person's intellectual property may or may not involve
    royalty payments or permission, but should always include proper credit to the source."



    Based on the definition of Intellectual Property, it would appear that stealing a picture from another seller's auction ad is nothing more than . . . copyright infringement, and well, just plain rude. Does a picture have any commercial value? Is it artistic work? Well, if it's a Monet, O'Keefe, or Warhol, maybe. If it's just a picture of his mother's old television set, I doubt it. Did the seller post a patent in his eBay ad? Ok, you get my point. We're talkin' copyright infringement, not intellectual property violation.

    If the other auction seller has provided proper credit to the seller they "borrowed" the pictures and auction ad from, then technically, the seller has not violated anyone's rights -- unless you already had a copyright notice on your ad that prohibited anyone from copying any part of your auction ad to begin with.

    How to protect your material:

    1. Include a copyright notice at the bottom of your auction ad. Your notice should read, for example: Copyright 2003 The Auction Board. All Rights Reserved. No Part of This Auction Ad Shall Be Reproduced Without the Express Written Permission of The Auction Board. All Graphics & Logos are Trademarks of their Respective Owners.

    2. If you find any part of your auction ad used by another seller, contact the seller and ask that they cease and desist immediately. Provide them with a link to your auction ad which will show them your copyright notice -- make every attempt to send a link to the ad that was copied.

    3. Give them 72 hours to respond. Follow up with them in 72 hours if they have not responded to you. If you wish to pursue, then call your attorney and have your attorney deal with the seller.

    International Buyers: Administrative Fees, Duties, and Taxes

    As per the United States Postal Service's website:

    "All items entering a foreign country are subject to customs inspection and the assessment of duties and taxes in accordance with that country's national laws. Customs duties and taxes are assessed, generally, if the merchandise is dutiable and the value of the item is above the threshold set by the country's laws. If duties and taxes are assessed on an item mailed via the Postal Service, they are collected from the recipient."


    Many sellers fail to mention that international buyers will be assessed custom duties and taxes once they receive an item. Then there are sellers who mention the duties and taxes by stating in their auction ad "please do not ask me to falsify custom documents." The duties and taxes are based on the value of the item.

    In addition to the duties and taxes, the buyer/recipient is charged an Administrative fee. To view the administrative fee, visit: USPS Duties & Administrative Fees

    A responsible seller would always make sure they list in their auction ad that all international buyers are responsible for Administrative fees, duties and taxes. The seller should never assume that the buyer would be aware of this. Even a car dealership tells a buyer that they're responsible for tax, tag and title. They don't just assume that you know that.

    eBay's SafeHarbor: Is it REALLY Protecting You?

    I used the online form to Safe Harbor, asking a very specific question to solve a problem I am having with an Ebay buyer.

    Funny, I get an answer back, sounds pretty formal, but non specific. Basically telling me that we aren't responsible blah blah....

    I wrote into Safe Harbor again, I get another response, EXACT SAME RESPONSE, word for word. Nice form letter response eh!!!!!!!

    What the hell. Do you know what I had to go through to speak to an actual human being at Ebay???? Then when I finally did, well sir, you will have to fill out a Safe Harbor form (which wouldn't work because the auction is already out of the system, as well as the purchaser!!!!!), finally I found a form that worked, sorta...... damn, do you know how easy they make it to find these online forms????? (being very sarcastic).

    Ebay......... You take my money, which is fine, but please, when there is a problem, and I need help, please make it seem like you're really doing something to help me out here.

    Whatever..........

    Here is what they wrote back: Email 1, Email 2. The difference is the name that appears at the end of the email, and a few other minor differences. Total form letter response.

    Makes ya wonder why they use the name SafeHarbor. The lesson to learn here is that eBay really isn't responsible for your safety while you use their services; neither does the company want to be. Members will continue to receive canned responses to complaints due to the incredible amount of complaints filed daily. Unless your complaint is flagged as something that will most likely affect eBay's bottom line, you won't get a quick response.

    Make Things Easier: Provide a Shipping Calculator

    Auction sellers are often asked, "Why does it cost so much to ship that?" By providing potential buyers with a shipping calculator, sellers can help themselves and help their buyers at the same time. The United States Postal Service and UPS currently offer scripts that will help sellers generate the code that will then allow them to place a shipping calculator within their auction ad. Auction sellers must not forget to inform buyers of any extra handling charges for shipping supplies -- even if the shipping calculator has been provided.

    Nucite.com created an excellent shipping calculator program that generates a script that auction sellers can add to their listings. This script is compatible with non-eBay auctions, so no matter where you sell, you can provide your buyers with this service. The Nucite calculator will calculate domestic and international shipping for the United States Postal Service and shipping to both the Unites States and Puerto Rico for UPS. You don't have to worry about visiting two different websites to figure out your shipping costs.

    Are Sellers Too Dependent on eBay?

    Many users report problems with eBay recently. This is particularly frustrating to sellers who are counting on eBay for the majority of their holiday business. Some of the technical problems reported by eBay sellers are:

  • Problems with the search function: when users search for items, eBay isn't returning all the items it should return.

  • Problems with sniping services: Users who utilize 3rd party sniping services may see problems with those services not working.

  • Some users are somehow finding themselves logged into other users' accounts.

  • Missing Favorite Sellers: Users are reporting that they can't find their favorite sellers.

    Tis the season for many frustrations on eBay. Perhaps having an e-commerce website up and running would be a good idea at this point. This would allow an eBay seller to easily point a buyer to his or her ecommerce website when eBay's services are not behaving as they should. Are sellers too dependent on eBay? Is this a good indication of that? The busiest shopping season of the year and sellers are frustrated by what appear to be simple technical issues.

    Item Count At Your Online Auction

    In a recent discussion from The Auction Board's discussion forum, a few members of TAB discussed the issue of placing the number of items up for auction next to the category name on the auction's main page:

    I'm just wondering why an owner of an auction site wouldn't put numerals up next to their categories to show how many items are currently available.

    ---- The numbers can be discouraging to a potential seller who sees a category with 0 next to it. Worse, the numbers can be discouraging when seeing several categories with small numbers.

    ---- The numbers can be discouraging to a potential buyer, perhaps? Someone finds your site in a search and sees your categories with small numbers next to them. They wonder how long you've been around and what kind of stability you have.

    ---- Both the potential buyer and seller sees your categories and sees HUGE numbers next to them, but no one's buying anything. That would make someone scratch their head too.

    Buyers complain that they're often taken in by shill bidders -- a seller who bids on his/her own item under a different username in order to artificially inflate the price of the item. When it's proven that the price was artificially inflated by a shill bidder, the buyer decides they no longer want the item. Who would want to buy from a dishonest seller, right? Buyers have complained that eBay still holds them responsible for paying for the item and will issue the buyer a NonPaying Bidder warning if the seller complains. Three of these NPB warnings and you're most likely booted off eBay.

    Now, why would eBay do that? Simple. Collection of the final value fee. If the seller files a NPB complaint against you, they can get their listing fee back and they don't have to pay a final value fee on the item.

    The argument given by some people as to why eBay would still hold you responsible for paying for the item is that the price of the item is reduced to the price you would have paid had the shill bidder not artificially inflated it to begin with. For example:

    You were bidding on an item and your last bid was $12.00. The shill bidder comes in and bids the item all the way up to $50. You can prove there was a shill bidder. eBay agrees and suspends the shill bidder's account, but not the seller's account (although the shill bidder was indeed the seller -- we all know this). You, as the buyer, are only obligated to pay $12.00 for the item. But, why would you send this jerk $12.00 for anything -- even a lung if you needed it! He was a dishonest loser who tried scammin' you.

    I wouldn't pay the seller either. I'd sit back and welcome the NPB warnings in my email box.

    Sunday Night Auction Closes

    When I first started selling on eBay I heard about the Sunday thing and also heard at the same time it also depends on what you are selling. So, to know which night really is best for what I sell I did a test. Every day for a week I would list a few auctions. This way I was able to see which nights ended with the most sales - which night(s) was really the best for what I was selling.

    After the end of my test I found that Sunday nights, Tuesday nights and Thursday nights were the best for me. One thing I also knew that is true to most kinds of things you sell is that always try to end your auction at a time that is a good time for both the east and west coast.

    Negative Feedback Removal Through Square Trade?

I know for a fact that I was once a member of Square Trade and I had a dispute with a seller (about those damn coffee beans he knew he didn't have in his possession, yet he took my money and never sent them). I gave him a negative, he gave me a negative to get back at me. I tried to get the negative removed thru Square Trade and they wouldn't remove it because the other seller didn't agree because I wouldn't agree to remove his. I quickly told Square Trqade to stick it and I canceled my membership. What good are they to me?

    Do Merchants Use eBay and VeRO to Bully Sellers?

    I received another submission from a reader regarding a VeRO disupte. Read the context of the email:

    I recently purchased a software program on Ebay called Spam Killer. It is written/sold by Network Associates. I installed the program on my computer and found it did not do a very good job as a lot of spam still got through. I removed the software from my computer and
    re-listed the item back on Ebay for sale. This is no different than if I bought a CD or DVD movie and did not like it. My ad on Ebay was very clear that I was selling an original but opened piece of software (not a copy). I have a 100+ good user rating and selling a copy of anything would be a real bad idea. Millions of original opened software items are for sale on ebay. I wovuld enture at least half of all software (computer, DVD, VHS, Cds) are opened items. There is no law or policy on ebay against selling used items of any kind (books, CDs, software, etc.). I have a large number of successful transactions on ebay (100+) and have been a member since the late 1990s.

    A few days later I received an e-mail (copy below) from Ebay that an employee from Network Associates (Shawn Stephenson email address Shawn_Stephenson@NAI.com) had signed an affidavit that the listing should be removed from Ebay. There was no letter or email from Network Associates beforehand asking me for details on my listing. Network Associates does not dispute that it was an original piece of software for sale. You will see below they even offered to buy back the software themselves. Of course this was not acceptable as I have a right to sell any legal item on Ebay as well as a right not to be censored by Network Associates. I never agreed to their license agreement especially since the software did not work as advertised.

    All of the emails to date are below (newest to oldest). The auction number of the auction I purchased the software from (still available for viewing for up to 30 days) is 3638894283. My auction has been taken down and I am trying to get a copy of it from Ebay.

    Any ideas on how I can get my listing back up or the best way to take legal action against Network Associates? They have an office in Atlanta so the least I could do is take them to small claims. Thanks!

    Vengeance is MINE Said Disgruntled eBay Buyers

    I received this from a friend who's a member of an eBay newsgroup. She asked me to post it here on The Auction Board's blog:


    reeb0k2 (reeb0k2@starmansion.com) defrauded folks on over 90 ebay transaction @ $150.00 each. See
    Scott Anton Scheirer for details. This thread is started to provide an online forum for the victims to communicate. The rest of this letter is to offer some background regarding the fraud and provide keywords for maximum exposure. I sent this letter to the victims of this scam to start pulling information as to their experience.

    I am going under the assumption that you have not received your DVD player from reeb0k2 purchased through eBay in October 2003. If you have, please let me know, as you are the only one in over a hundred
    that did. For the rest of us, it looks like we were defrauded out of many thousands of dollars in total.

    Well, let me tell you what I've done with respect my situation. Some of you have noticed that If you look back at your auction page or feedback page you'll see that reeb0k2 is no longer a registered user.
    If you look up his contact information, it is bogus too. TSM Systems Inc., the business accepting payments through PayPal and a name that will show up on your credit card bill, also has bogus contact
    information. TSM Systems now displays no contact information and states they are in the process of moving. I have found sources that state TSM Systems and Scott A. Scheirer (aka Scherer) share the same at address; 607 N. 10th St. Reading, PA 19604. I found several phone numbers that are bogus except two that I haven't verified if the seller lives there or not. Both of these have a different (female) voice recording. He listed his name with eBay (Scherer) and PayPal (Scheirer) differently. I found him as Scott Scheirer on Classmates.com, USSearch.

    I corresponded with him several times and only got non-responsive, cryptic replies to my inquiries; the same lies and omissions you all have received. The responses are obvious attempt to string us along while he spends our money without delivering the product.

    Recently, I was sending very polite emails to reeb0k2@starmansion.com in order to keep him talking and try to get a refund. Knowing I was not going to get one I wanted to give the appearance of trying for the
    benefit of my credit card complaint. They wanted to know if I asked for a refund. Beginning on 10//24/03, my emails were met with auto replies that are giving me two new emails to send emails. These are:
    irc@abynet.net and . As I said before, try . Now try and you'll find Scott Scheirer is there too. He must be starting a new venture with our capital.

    I have reported him as a fraud to: eBay, PayPal,, Bank of America Credit Card services, and the Internet Fraud Complaint Center (IFCC) at their website. This agency is in partnership with the FBI. It takes a little time to fill out the online form, but if this person gets nailed it will be worth it, right. Only with more reports to the IFCC will the Feds get involved and hopefully this person will see some real financial difficulty and perhaps jail time.
    The IFCC will distribute the reports to the law enforcement agencies in your area and in Reading, PA. All the information I have has been provide to this agency. Looks like we have enough folks here for class
    action.

    EBay and PayPal admitted that the seller was at fault, but were useless as I received messages that they can't help me. His Paypal account is frozen and there is nothing in it to recover, therefore don't count on Paypal to recover for you. Bank of America initiated the chargeback procedure for me and is going after the crook.

    Even if I get my money back, I will pursue legal action against this person. It seems that as time goes on more of these rip-off artists are showing up. If eBay won't do anything, maybe we can. A phone call to the Reading, PA police may help get someone to this jerk's door.

    Good luck to all and spread the word, especially to the newbies that got taken, too. If you would like to keep informed as to what progress is made with me, let me know, otherwise I won't bother you. Thanks again for your time take care.

    UPDATE TODAY 10/27/03

    Here's an update on our friend Scott Scheirer (aka reeb0k2). I called the Reading, PA police department (610-655-6116) and spoke to Joe Cafoncelli (badge # 242). I found out that Mr. Scheirer is not unknown
    to them. Fraud by deception seems to be a hobby of his as there were records found on the computer system as late as 2002. Mr. Cafoncelli's recommendation is for all of us to make our complaints to the IFCC. Here is the link again for your convenience.

    These complaints will be compiled by the U.S. Attorney General and the total amount of the fraud will be charged in the case. If we file the cases individually with the Reading, PA police department, they become
    multiple misdemeanor cases rather than a single federal felony case. We will also have to take a trip to Reading to testify which will cost more than the $150.00+ we've been taken for. This doesn't mean that Mr. Cafoncelli doesn't want to hear about your particular experience.
    I told him that, very likely, he will be getting many calls from across the nation and perhaps internationally. I'm sure getting numerous complaints may help him keep an eye on Scheirer's activities. If you are lucky enough to have paid by credit card, chances are good that going through your credit card company will get you your money back; start the chargeback procedure now.

    Also, file complaints with eBay and Paypal as a matter of record. Scheirer's Paypal account is frozen and eBay suspended him already, therefore don't plan on getting anything from them. However, this is more evidence that you have done everything you can and it will not
    hurt, yet it could help.

    Even though Paypal will not help you, your credit card company will hit Paypal for the money. Paypal/eBay will be forced to find some other solution. If you get your money back from your credit card company, there goes your stake in any legal proceedings and good for
    you. Paypal will then have to go after Scheirer since your card company will short Paypal on their next payment to get their money. Eventually, Scheirer will get his and the more of us that file a complaint the faster this will happen.

    Don't wait to file with the IFCC; the DVD player(s) or refund will not come. You all have conveyed your experiences to date and unfortunately they are sounding the same. Together we can get this guy off the net and into a cage where he belongs. Let's flood the IFCC like Schreirer did eBay with his auction listings.

    As eBay community members, we have to take care of each other sometimes even though eBay seems to be losing control. If your credit card company makes things good for you, please file your complaint anyway to the FCC so that those that used direct bank draft will have our help as well. There is power in numbers.
